The Crisis in Arizona’s Judiciary, Part Two:


Judges to Benefit from Their Own Rulings?


PHOENIX, ARIZONA. JULY 14, 2010. As part of his campaign for Attorney General, which includes a promise to seek judicial reform, Andrew Thomas noted today that four of the people seeking $46 million in payouts from county taxpayers are Maricopa County judges. They have filed claims which essentially stand to reward them for their misbehavior as judges.


Four Maricopa County Superior Court judges have filed claims seeking a total of $17.25 million from Maricopa County taxpayers. They are former Presiding Judge Barbara Mundell, Gary Donahoe, Anna Baca and Kenneth Fields. As noted by Laurie Roberts in a recent column in the Arizona Republic, these four, along with other individuals, have filed claims that county officials have diverted into mediation. Normally, the county fights such claims in court.


However, county officials have rigged the system so these insiders can receive payouts without having to testify under oath or convince a jury of the justice of their cause. Some of the other claimants seeking these taxpayer payouts and receiving this special treatment are two county politicians twice indicted by a Maricopa County grand jury (Donald Stapley and Mary Rose Wilcox) and a convicted felon (Conley Wolfswinkel).

INTEREST AND STATEMENT OF POSITION OF AMICI CURIAE
Michael A. Cox is the Attorney General for the State of Michigan, which shares
constitutional and common law roots with Arizona. Attorney General Cox is authorized by
statute to intervene on behalf of the People of the State of Michigan in any court or tribunal
when, in his judgment, the interests of the People are implicated. Mich. Comp. Laws § 14.28.
See also Associated Builders and Contractors v. Perry, 115 F.3d 386, 390-392 (6th Cir. 1997).
Like Arizona, the State of Michigan and the amici States have the power to concurrently
enforce Federal immigration law, provided that the States do not create new categories of aliens
or attempt to independently determine the immigration status of an alien. This is the regulatory
scheme envisioned by Congress – which is one of concurrent enforcement – where the Federal
government must respond to any inquiry by a State or local government agency seeking to verify
the immigration status of any person within its jurisdiction. 8 U.S.C. § 1373(c). Such a duty is
predicated on the principle that the States have the authority to make those inquiries regarding
whether aliens are residing illegally within their borders. Indeed, that is precisely what A.R.S.
11-1051 and A.R.S. 13-3883(A)(5) seek to do – identify unlawful aliens within the jurisdiction
of Arizona and to bring those persons to the attention of Federal immigration authorities.1
By lawsuit, rather than by legislation, the Federal government seeks to negate this preexisting
power of the States to verify a person's immigration status and similarly seeks to reject
the assistance that the States can lawfully provide to the Federal government. That result
contravenes Congress's intent of cooperative enforcement and replaces it with a regulatory
scheme whereby the Federal government may continue to selectively enforce – or as

Plaintiff, the United States of America, by its undersigned attorneys, brings this civil
action for declaratory and injunctive relief, and alleges as follows:
INTRODUCTION
1. In this action, the United States seeks to declare invalid and preliminarily and
permanently enjoin the enforcement of S.B. 1070, as amended and enacted by the State of
Arizona, because S.B. 1070 is preempted by federal law and therefore violates the
Supremacy Clause of the United States Constitution.
2. In our constitutional system, the federal government has preeminent authority to
regulate immigration matters. This authority derives from the United States Constitution and

The American Bar Association (“ABA”), as amicus curiae, respectfully submits
this brief in support of Plaintiffs’ Motion for Preliminary Injunction (Docket No. 70),
filed on June 4, 2010. While the ABA typically files amicus briefs only in the highest
federal or state court that will consider a matter, the ABA believes the issues before this
Court are of such significance to the American people and the practice of law that they
must be addressed at this stage of the proceedings. The ABA will not expand upon the
Plaintiffs’ constitutional arguments, including preemption, but rather will limit this brief
to a discussion of the impact that S.B. 1070, if implemented, will have on four issues that
are of deep concern to the ABA: (A) the increased use of racial profiling in law
enforcement; (B) the mandatory detention of citizens and noncitizens; (C) the increased
burden and new obligations on Arizona’s indigent defense system, as well as its courts
and prosecutors; and (D) the attempted usurpation of exclusive federal authority to
