GOP attorney general candidate R. Christopher Barden is regarded as a complete unknown by many at the GOP convention, and this bit of news may not help: According to Hennepin County property tax records [PDF], the Edina home of the Republican endorsee for AG is not homesteaded.

Primary residences typically are homesteaded for tax purposes. Barden, who has also lived in Utah, told PIM today that he was uncertain about the homestead status of his house and would have to check into it, but added that it is “absolutely” his primary residence — “and my only residence,” he went on to say.

Barden said he has lived in the house since August of 2007. Regarding his Minnesota residence bona fides, he added that “I have been licensed to practice in Minnesota since 1992, and I have paid taxes in Minnesota since 1992. We only moved to Utah to take care of my mother-in-law, who had Alzheimer’s Disease.”

[JURIST] Two Latino advocacy groups say they plan to challenge the constitutionality of Arizona's new immigration law, alleging it permits racial profiling. SB 1070 [text, PDF], signed into law [JURIST report] Friday by Governor Jan Brewer, permits police to question the immigration status of suspected illegal immigrants. Officials from the Mexican American Legal Defense and Education Fund (MALDEF) [advocacy website; press release] and the National Coalition of Latino Christian Clergy [advocacy website] contend the law will let police single out minorities for immigration inspections. Under the law, it is designated a crime [AP report; JURIST report] to be in the country illegally and immigrants unable to verify their legal status could be arrested and jailed for six months and fined $2,500. MALDEF said the law creates a separate state scheme to enforce immigration violations:
One significant measure of SB 1070’s patent illegality is that it seeks to implement Arizona’s own scheme of immigration regulation – separate and in conflict with federal government policy – when our Constitution envisions a unified nation under one federal set of immigration regulations to be adopted by Congress and implemented by the President. By rejecting that constitutional plan, Arizona’s enactment of SB 1070 is tantamount to a declaration of secession. In response, the federal government must act to preserve our united nation by clearly stating that it will not cooperate in any way with the implementation of SB 1070 – that it will not adjust or alter its immigration enforcement priorities to the detriment of other states simply to accommodate Arizona's most recent exercise in racial demagoguery.
Brewer says she will instruct [text of speech] the state's police departments to implement the law without violating civil rights.

The Arizona law is one of the strictest [JURIST report] illegal immigration regimes in the nation. Proponents of the bill claim [Reuters report] the new law will decrease illegal immigration from Mexico. Suing To Elect A Supreme Court Justice





In Minnesota Supreme Court Justices are supposed to be elected. However, Minnesota's Chief Justice hasn't been election in the last 10 years. That's because of the timing of the resignations of the last three Chief Justices. Governor Tim Pawlenty has appointed each of them and each of them resigned before they faced election.



There is a court challenge to allowing the Governor to appoint a new Chief Justice in the wake of Chief Justice Eric Magnuson's resignation effective in June. The suit asks for voter intervention. The Minnesota Supreme Court heard oral arguments in the case, but Governor Tim Pawlenty's appointees on the court recused themselves from hearing the case.

Retention / Election Bill


SF 70 - Senator Ann Rest / HF 224 - Representative Steve Simon


This bill proposes an amendment to the Minnesota Constitution to change the process for the selection of state court judges. The bill would amend the Constitution and relevant statutes to require that judges who have been initially appointed by the Governor stand for a retention election at the next regularly scheduled general election held more than three years after the appointment of the judge. If the majority of voters vote "no," the office would be declared vacant and the Governor would appoint a new individual to fill the vacancy, as provided under current law. If the voters decide to retain the judge, the judge would serve an eight-year term. (Overview provided by Senate Counsel.)
